Terms and conditions.

1. About GameClash

GameClash is a collection of puzzle and word games that you can practise, play every day in the daily challenge and play in duels for virtual coins. GameClash is offered by:

2. Your account

• You may have one account per person. You use the same account on the website and in the app.
• Give correct details when you sign up and keep your login details to yourself. You're responsible for what happens with your account.
• Choose a username that isn't offensive, discriminatory or misleading and doesn't look like someone else's or like GameClash itself. We may refuse a username or ask you to change it.
• Notice that someone else is using your account? Change your password and let us know as soon as possible.

3. Age

You must be at least 16 years old to create an account. If you're younger, you may only play with permission from your parent or guardian, and only buy something with their permission.

4. Coins, diamonds and tickets

• Coins, diamonds and tickets are virtual items within GameClash. You get the right to use them in the game. They remain the property of GameClash and have no value outside the game.
• You can't exchange them for money, get a refund for them in money, move them to another account or sell them to others.
• Coins are your stake in duels. Diamonds are for the Style shop and the Arcade Wheel. Tickets are entered into prize draws.
• The Arcade Wheel only accepts diamonds you earned in the game, not diamonds you bought.
• If an error leaves too much or too little on your account, we may correct it.

5. Purchases

• You can buy coin packs in the coin shop. You see the price before you pay, including VAT.
• On the website you pay through Mollie, for example with iDEAL or a credit card. In the app you pay through Apple. Apple's terms also apply to purchases in the app, and refunds for those go through Apple.
• Coins and diamonds are digital content that we deliver right after your payment. By completing the purchase, you agree to this immediate delivery. Your 14-day right of withdrawal therefore ends as soon as the coins are in your account.
• Did something go wrong with a payment, for example money was taken but no coins were added? Contact us. We'll look into it and put it right.
• You never have to buy anything to play GameClash.

6. Duels

• In a duel, two to four participants play the same puzzle. You choose a stake of 20, 50 or 100 coins. The stake is deducted as soon as you join.
• All stakes together make the pot. A fixed percentage of it goes to the GameClash prize fund. You see how big the pot is and what you can win before you start.
• The highest score wins the pot. If the top score is tied, the winners share the pot. Every participant plays only once.
• If a duel doesn't fill up in time, it's called off and you get your stake back.
• The clock starts when you press Play and keeps running, even if you close the page or leave the app. You can't replay a round you've started.
• Scores, times and results are calculated and recorded by GameClash. That result is final. If we make a mistake with a result, we may correct it.

7. Daily challenge, rankings and album

• The daily challenge is free. You get one attempt per day. The best score wins the reward shown in the daily challenge; if scores are tied, whoever reached that score first wins.
• The weekly rankings run from Monday 00:00 to Monday 00:00 (Dutch time). Only duels count. The rewards for the top 3 are shown with the rankings and are added automatically after the week ends.
• You get sticker packs for the Arcade Album after duels in which you really played, up to a daily maximum. Stickers and stars have no value outside the game.

8. Prizes

• On the Prizes page you can enter tickets into a prize draw. Every ticket entered is one chance. Entered tickets are used up after the draw, even if you don't win.
• Winners are drawn at random at the announced time. You can win only once per draw. Some prizes are only available to players with a certain language.
• Coin prizes are added automatically. For other prizes we ask for your name, email address and, if needed, your address. If you don't provide them within 30 days, we may cancel the prize or give it to another winner.
• Prizes can't be exchanged for money or another prize. If a prize is no longer available, we may give a comparable prize.
• We may exclude players who break these terms from a draw or reclaim a prize.

9. Fair play

GameClash is only fun if everyone plays fair. So you may not:

• use scripts, programs or other tools that play for you automatically or give you an unfair advantage;
• use several accounts, share accounts or team up with others to influence results;
• deliberately abuse bugs in GameClash instead of reporting them to us;
• hack or disrupt GameClash or try to access other people's data;
• harass other players or post offensive content.

If you do, we may reverse rewards and winnings, exclude you from prizes and rankings, and block your account temporarily or permanently. We always consider what is reasonable.

10. Availability and changes

• We do our best to keep GameClash running smoothly, but we can't promise it will never have problems. Sometimes GameClash is briefly unavailable, for example for maintenance.
• GameClash is in active development. We may change, add or stop games, rewards, prizes, stakes and other features. Duels that are already running are finished under the rules that applied when they started.
• We may change these terms. For important changes we let you know in advance. If you keep playing afterwards, the new terms apply. If you don't agree, you can delete your account.

11. Liability

GameClash is a game for fun. We're not liable for damage caused by outages, lost progress or virtual items, or GameClash being unavailable, unless that damage is caused by intent or gross negligence on our part. If GameClash is liable after all, this is limited to the amount you paid GameClash in the twelve months before. Your statutory consumer rights always continue to apply.

12. Closing your account

• You can delete your account at any time, in Settings on the website or under Profile in the app.
• After deletion your coins, diamonds, tickets, stickers, style items and progress are gone. You don't get money back for them. This can't be undone.
• If you seriously or repeatedly break these terms, we may block or close your account.
• If we stop GameClash, we'll let you know at least 30 days in advance.

13. Rights to GameClash

All games, texts, illustrations, sounds, names and logos of GameClash belong to us or our licensors. You may use GameClash to play, but not copy, sell or otherwise use it without our permission.

14. Questions and complaints

Have a question or complaint? Send us a message through the contact form. We usually reply within two working days and try to resolve your complaint within 14 days. If we can't work it out together, you can take the dispute to court (see below).

15. Applicable law

Dutch law applies to these terms and the use of GameClash. If you live in another country of the European Union, you keep the protection that country's consumer law gives you. You can bring a dispute before the competent court in the Netherlands or where you live.
